MEMORANDUM AND ORDER

CORCORAN, District Judge.

This matter is before the Court on cross-motions for summary judgment. Fed.R.Civ.P. 56. The parties have agreed that there are no material facts as to which there is a genuine dispute, that only legal issues remain, and that summary judgment accordingly is the appropriate vehicle for disposition of the case. See, e. g., Leonard v. BHJK Corp., 152 U.S.App.D.C. 97, 99, 469 F.2d 108
