This is an appeal by the state from an order of the district court remanding a criminal action to the magistrates' division of the district court for a second preliminary hearing. The district court's order was in response to defendant's motion to dismiss the information, on the ground of insufficient evidence to establish probable cause at the original preliminary hearing.
