OPINION

BURNS, District Judge:

Plaintiffs bring this action under the Federal Tort Claims Act, 28 U.S.C. Sec. 1346(b), 2671 et seq. to recover damages resulting from destruction of their private plane which crashed while on its way to Portland International Airport October 9, 1970. Their claim was presented to the Federal Aviation Administration (FAA) and finally denied by that agency on November 5, 1971. Plaintiffs are husband and wife, residents of California...
