HEANEY, Circuit Judge.

Arman Kiliyan, Jr., was convicted on two counts of violating federal firearms statutes. Count I involved the making of firearms (two hand grenades) without filing application and without payment of a making tax, in violation of 26 U.S.C. § 5861(f). Count II involved the transfer of the same firearms without paying a transfer tax, in violation of 26 U.S.C. § 5861(e).
