OPINION

BUSSEY, Judge:

Appellant Cleve Miller, hereinafter referred to as defendant, was charged with the crime of Murder in the District Court, Tulsa County, Case No. CRF-73-577. He was convicted of the offense of Manslaughter in the First Degree and sentence to ten (10) years imprisonment. From said judgment and sentence a timely appeal has been perfected to this Court.
