Defendant appellant, Max Schecter, was indicted by the Cuyahoga County Grand Jury on February 13, 1973, for the crimes of murder in the first degree (R. C. 2901.01), assault with intent to kill (R. C. 2901.24), and unlawful possession of a firearm (R. C. 2947.30). The case was tried to a jury and on June 12, 1973, the jury found the defendant appellant guilty of the lesser included offenses of murder in the second degree and aggravated assault and a verdict...
