Appellant Hairston was tried jointly in the District Court with Archie J. Lee, and both were found guilty of violations of the federal narcotics laws. 26 U.S.C. § 4704(a) and 21 U.S.C. § 174. Appeals followed, and that of Lee has heretofore been disposed of by affirmance. Hairston's appeal was held in abeyance pending this court's en banc resolution of United States v.
