Plaintiff was a Department of Defense civil service employee at Holloman Air Force Base, New Mexico, when he was ordered terminated from his position on September 28, 1970. The termination was effected by the Civil Service Commission based on the provisions of a Federal Regulation requiring competitive civil service employees to be citizens of the United States.
