On November 6, 1970, the defendant pled guilty to voluntary manslaughter, MCLA 750.321; MSA 28.553, and on December 18, 1970, was sentenced to 5 to 15 years in prison. On November 28, 1972, this Court granted the defendant's application for delayed appeal.1
