OPINION

BUSSEY, Judge:

Defendant, Larry Don Fite, was charged with the offense of Unlawful Delivery and Distribution of Marihuana in the District Court, Bryan County (CRF-72-130). He was found guilty by jury verdict and in accordance with that verdict was sentenced to imprisonment in the State penitentiary for a term of ten (10) years.
