This diversity and civil rights action for damages was begun by the widows and dependents of numerous coal miners who were killed in the course of their employment in a mine explosion in West Virginia, the mine being owned and operated by the defendant, Consolidated Coal Company and supervised by its president, John Corcoran, also a defendant.
