MEMORANDUM
WARRINER, District Judge.
The parties are before this Court pursuant to defendants' motion to dismiss the complaint, or, in the alternative, to abstain from deciding the case in order to afford the Virginia courts an opportunity to pass on the question of whether defendants complied with the state statute under which plaintiff seeks relief: § 22-217.4 et seq., Code of Virginia 1968.
