OPINION

ROBERTS, Judge.

The appellant was convicted of the offense of burglary with intent to commit theft. Punishment was assessed by the court at six years' imprisonment.

Both of appellant's grounds of error on this appeal are based upon his contention that the trial court should have upheld his plea of former jeopardy. Appellant was previously put to trial in the same court and on the same indictment, but the jury was unable to reach a verdict...
