SOMERVILLE, Judge.

Defendant, charged with murder in the second degree by information in the Circuit Court of Harrison County, stood trial by jury and was found guilty of manslaughter. The jury assessed defendant's punishment at five years confinement in the Department of Corrections. Judgment and sentence were rendered accordingly, and defendant duly perfected an appeal to this court.
