OPINION AND ORDER

FOGEL, District Judge.

This is an action brought by Francis X. Dufner, an employee of the Penn Central Transportation Company (Penn Central), pursuant to provisions of the Military Selective Service Act of 1967, as amended, 50 U.S.C. App. § 459 (hereinafter referred to as the Act).1 Jurisdiction is conferred upon this Court by 50 U.S.C. App. § 459(d).
