Defendant Eddie Brunson, who was tried in the Circuit Court of Jackson County, was found guilty by a jury of the crime of burglary, second degree (Section 560.045, RSMo 1969, V.A.M.S., and, in view of the jury's inability to agree on his punishment, was sentenced by the court to three years confinement in the Department of Corrections.
