Petitioner O'Shea was convicted of armed bank robbery, 18 U.S.C. § 2113(d), after a jury trial. Before sentencing, the district court reviewed a presentence report which disclosed that this was petitioner's second such offense. It also showed eight state misdemeanor convictions ranging from assault and battery and unlicensed carrying of a revolver, to contributing to the delinquency of a minor.
