GORBEY, District Judge.

Defendants have filed two motions. The first is to dismiss the complaint pursuant to Federal Rules of Civil Procedure, R. 12(b), and the second is to strike the averments of paragraphs 7, 8, 9 and 10 of the complaint pursuant to Federal Rules of Civil Procedure, R. 12 (f). In response to these motions, plaintiff filed an amended complaint. As a result of this amended complaint, defendants have withdrawn their objections...
