Plaintiff, surviving widow of Sam Allen Wayne, sued Olinkraft, Inc., in tort, for the death of her husband which was allegedly caused by the negligence of Olinkraft at its sawmill located at Huttig, Arkansas, on August 28, 1970. Defendant filed an answer and a motion for summary judgment. The motion was supported by attached affidavits setting forth defendant was a statutory employer of plaintiff under the Louisiana law and as such plaintiff's sole remedy...
