ARCHIBALD, Justice.

Appellant was indicated, tried and convicted of felonious homicide punishable as murder. 17 M.R.S.A. § 2651. At the conclusion of the testimony defense counsel stated to the presiding Justice: "[W]e do request a Charge in this case, based on the facts, on manslaughter." This request was denied.
