Defendant-appellant Charles Bell was charged by affidavit with the offense of second degree arson as defined in IC 1971, 35-16-1-2, Ind. Ann. Stat. § 10-302 (Burns Supp. 1974), which provides as follows:

"Any person who wilfully and maliciously sets fire to or burns, or causes the setting of fire to or burning, or who aids, counsels or procures the setting of fire to or the burning of any barn, garage, stable or other building,...
