PEOPLE v. MUSSER

No. 26240.

529 P.2d 626 (1974)

The PEOPLE of the State of Colorado, Plaintiff-Appellee, v. Mark Rowley MUSSER, Defendant-Appellant.

Supreme Court of Colorado, En Banc.

December 23, 1974.

Attorney(s) appearing for the Case

John P. Moore, Atty. Gen., John E. Bush, Deputy Atty. Gen., Gregory L. Williams, Asst. Atty. Gen., Denver, for plaintiff-appellee.

Montgomery, Little, Young & Ogilvie, P.C., David A. Ogilvie, Denver, for defendant-appellant.

PRINGLE, Chief Justice.

This is an appeal from a Crim.P. 35(b) hearing in which the Jefferson County District Court refused to vacate a plea of guilty. The defendant Mark Rowley Musser contends that reversal of the district court is required because of our order to vacate the guilty plea of his co-defendant, Kenneth Keenan, in People v. Keenan, Colo., 524 P.2d 604. We disagree and affirm the ruling of the trial court.
