Plaintiff, Steven Trahan, received brain injuries that reduced him to a mental incompetent caused by his ejection from a moving truck on the Eastex Freeway in Houston, Texas. He filed a tort action against Milton H. Girard, doing business as Girard Plumbing & Sprinkler Co., his employer, as owner of the truck; Continental Insurance Company, Girard's liability insurer; and Robert R. Walker, a coemployee driving the truck with the owner's permission...
