WEATHERBEE, Justice.

Jeffrey Don Maxwell was found by a jury to be guilty of the offense of Armed Assault and Battery under 17 M.R.S.A. § 201-A.1 On June 21, 1973, he was sentenced to a term of two to four years at the state prison, and it is from this conviction and sentence that he appeals.
