OPINION

DON J. YOUNG, District Judge:

This is an action by the plaintiffs to recover income taxes which they claim were improperly assessed against them. At the time of trial, the action had been pending for about six years. The taxes involved are for the year 1952. At an earlier stage of the proceeding it was held that the greater part of the plaintiffs' claim was barred by the statute of limitations. The trial was thus concerned with a balance of $15,771...
