JONES, Justice.

The Cities of Helena and West Helena, acting through their Airport Commission, leased their airport land and facilities to E. E. Terry, Inc., hereafter referred to as "Terry." The cities sued Terry for back rent and Terry counterclaimed for damages. A jury was waived and the trial judge sitting as a jury rendered judgment in favor of the cities for $3,522.48 in back rent and dismissed Terry's counterclaim.
