Defendant, the appellant herein, was indicted on counts of assault with intent to rob, and with the unlawful killing of one Walter Hemmig while attempting to perpetrate a robbery. A trial by jury was had on the pleas of not guilty, resulting in verdicts of guilty on both counts, and sentence was thereafter passed as appears of record. A motion for new trial was timely filed, argued, and in due course overruled...
