CONNOR, Justice.

On October 10, 1972, a grand jury returned an indictment against appellee Windie Lamar Johnson for grand larceny. The only witness before the grand jury was an employee of the store where the larceny had allegedly taken place. This witness, Mr. Richard Glessner, had not actually seen Johnson take any items.
