This is an appeal from a summary judgment. Morris B. Moore on February 6, 1959, entered into a written contract to purchase a tract of land located in Travis County, Texas, from Appellee J. V. Mohon. Pursuant to the contract, Morris B. Moore was furnished an owner's title policy commitment (title insurance binder) which informed him of the pendency of a lawsuit pending in a District Court of Travis County, Texas, styled, "R. M.
