GEWIN, Circuit Judge:

On May 18, 1972, a two-count indictment was returned charging appellant Scott Harris with two violations of the Dyer Act.1 On August 2, 1972, Harris' first trial resulted in a deadlocked jury; thus the district court declared a mistrial.
