This is an appeal from the decision of the Patent Office Board of Appeals affirming the examiner's rejections under 35 U.S.C. §§ 102 and 112 of the claim in appellant's application1 for a plant patent entitled "Bermuda Grass Plant." We affirm that decision insofar as it is based on § 112.
