Defendant-appellant, James C. Wright, was convicted by a jury of first-degree murder and sentenced to life imprisonment. He will be referred to as defendant or Wright.

On April 19, 1970, defendant and his parents, Clifford and Essie Wright, had visited relatives in Dove Creek. On their way home, they observed the decedent, Claude Rhoades, and his wife coming from the opposite direction in their pickup...
