This is an action brought by the plaintiff, Eugene Molinari, to recover damages for injuries sustained in 1963 as a result of the alleged negligence of the defendant, Sinclair Refining Company.1 The case was tried to a jury in the Superior Court, and at the conclusion of the introduction of evidence, the defendant's motion for a directed verdict was granted by the trial justice.
