On certificate for immediate review, the defendant appeals from the judgment of the Superior Court of Clayton County denying his motions to dismiss the plaintiff's complaint on the grounds (1) that the complaint failed to state a claim against the defendant upon which relief can be granted and (2) that the contract for the sale of realty is invalid and unenforceable as a matter of law.
