This matter arises from a collision on January 21, 1969, between the F/V Endeavour (owned by plaintiff), and the tug Gorham H. Whitney (owned by defendant). The district court found the Endeavour solely at fault and dismissed plaintiff's complaint. The Court of Appeals, 457 F.2d 755, 758, finding both parties at fault, reversed the district court and remanded the case "with directions to award...
