On January 19, 1971, Veeck instituted this diversity action in the U.S. District Court for the District of Arizona.

The plaintiff alleged that on October 19, 1969, an Arizona newspaper published a want-ad which had been placed by the defendants' agent. The ad purported to seek a person to operate the defendants' soon-to-be-established commodities brokerage office. It stated that the defendants would both train the applicant...
