Defendant herein was sentenced in this court, following a jury verdict of guilty of rape in the first degree, to a term of one day to life under the provisions of section 2189-a of the former Penal Law. The sentence was pronounced April 29, 1970 but the crime was committed on April 25, 1966, hence the applicability of the provisions of the former Penal Law.
