HARMAN, Justice.

Willie Stanley Boone (Boone or defendant),1 after waiving a trial by jury, was convicted by the trial court of a violation of the "Sawed-off" Shotgun Act, Code §§ 18.1-268 to 268.9, and sentenced to a term of ten years in the state penitentiary. We granted a writ of error.
