In June of 1970, the plaintiff filed a medical malpractice suit against the defendant doctor in Common Pleas Court of Fayette County, Pennsylvania. The case was tried in January of 1973 and ended in a hung jury. Thereupon, plaintiff brought this action in federal court, alleging a conspiracy between the defendant and a juror to deprive plaintiff of a favorable verdict, allegedly in violation of 42 U.S.C. § 1985.
