This case is before the Court upon a writ of error and supersedeas to the final judgment of the Circuit Court of Roane County, entered on March 26, 1971, upon a jury verdict finding the defendant, Henry Tod Duvernoy, guilty of possession of marijuana. By its final judgment, the circuit court sentenced the defendant to a term of not less than two years nor more than five years in the West Virginia Penitentiary...
