This is an appeal from a final order of the Circuit Court of Logan County entered on November 1, 1967 sentencing the defendant below, Kirtley E. Bias, to five to eighteen years in the state penitentiary. The judgment of the circuit court was entered upon a jury verdict which found the defendant guilty of murder in the second degree.
