Appellants, each the owner of land situated in close proximity to a site selected by the City of Baytown to serve as a sanitary landfill, brought suit in the district court in the nature of an appeal from an action of the Texas State Department of Health under the Solid Waste Disposal Act, Article 4477-7, Vernon's Civil Statutes. The State filed a plea in abatement maintaining that appellants had no justiciable interest to maintain their appeal...
