The defendant was convicted by a jury of assault with intent to commit rape, MCLA 750.85; MSA 28.280, and of breaking and entering an occupied dwelling house with intent to commit a felony therein, MCLA 750.110; MSA 28.305. The defendant was sentenced to concurrent terms of 6 to 10 years in prison for assault and 10 to 15 years in prison for breaking and entering, less 877 days already served.
