TYSON, Judge.

The Grand Jury of Jefferson County, Alabama, charged the appellant with robbery. The Jury's verdict and judgment set sentence at twenty-five years imprisonment in the penitentiary. Appellant's motion for new trial was denied.

The first witness to testify was Early Meriweather, the victim of the alleged robbery. He testified that he was seventy-eight years old and was currently living in Syracuse, New York. During the first part of July, 1971...
