At the trial in the Superior Court, and upon his subsequent appeal to this Court, Yoes was represented by privately employed counsel. Hairston, Hale and Davis were represented by court-appointed counsel.

Upon the imposition of sentences in accordance with the verdict, each defendant, in open court, gave notice of appeal to this Court. Each defendant, in due time, petitioned the Superior Court for permission to prosecute his appeal in forma pauperis...
