ODOM, Judge.

This is an appeal from a conviction for the offense of sale of whiskey in a wet area without a permit or license; a fine of $100.00 was assessed as punishment.

It is appellant's contention that the evidence is insufficient to support the conviction in that the state failed to prove (1) "that the premises in question was not covered by a license or permit issued by the Texas Alcoholic Beverage Commission or the Texas Liquor Control...
