OPINION

BRETT, Judge:

Appellant, William K. Jones, hereinafter referred to as defendant, was charged, tried and convicted in the District Court of Kay County, Case No. CRF-71-79, for the offense of Assault With a Dangerous Weapon. Defendant was sentenced to two and one-half (2 1/2) years imprisonment and from said judgment and sentence, the defendant has made a timely appeal to this Court.
