This unusual appeal involves an endeavor by a party who was defeated in a prior divorce suit to have the decree in that suit declared void on the ground the parties to that suit were never married to each other.

According to the allegations of his present petition, in 1939 plaintiff-appellant A. Clarence Motz (Motz) married a woman named Therese, in 1962 he married a woman named Keith (defendant-appellee here), in 1966 he and Keith separated...
