OPINION

ROBERTS, Chief Justice.

This is an indictment charging the defendant with possession of a burglary tool, to wit, a tire iron. The case was tried to a justice of the Superior Court sitting with a jury which returned a verdict of guilty as charged in the indictment. The defendant's motion for a new trial was subsequently denied by the Superior Court, and he is now in this court prosecuting a bill of exceptions.
