On March 10, 1966 the Appellant, Thomas Lee Neeley, was charged by way of affidavit of the offense of robbery. The case was tried before the trial court without the intervention of a jury on July 28, 1966 and the defendant was found guilty. On August 2, 1966 the defendant was sentenced to the Indiana State Reformatory for an indeterminate term of 10 to 25 years. A motion for new trial was overruled on September 25, 1966.
